2. Scope

These General Terms and Conditions of Sale (hereinafter “GTC”) govern all commercial relations between SVD Commerce Sàrl (hereinafter “CaviarNoir,” “we”) and any person making a purchase on the websitecaviarnoir.ch hereinafter the “Customer,” “you”).

By placing an order on our website, the Customer acknowledges that they have read these Terms and Conditions and accept them without reservation. CaviarNoir.ch the right to modify these Terms and Conditions at any time. The version in effect is the one published on the website at the time the order is placed.

 

3. Products

CaviarNoir.ch caviar and luxury food products. All of our caviar comes from sustainable aquaculture farms certified by CITES (Convention on International Trade in Endangered Species of Wild Fauna and Flora).

Product photographs and descriptions are for illustrative purposes only. Slight variations in color or appearance may occur without affecting the quality of the product.

 

4. Pricing and Payment

All prices listed on the website are in Swiss francs (CHF) and include all taxes, in accordance with the Ordinance on Price Indication (OIP). Shipping costs are shown separately before the order is confirmed.

We accept the following payment methods: credit card (Visa, Mastercard), TWINT, bank transfer, and other methods listed during the checkout process.

The order is not confirmed until full payment has been received.

 

5. Conclusion of the contract

The presentation of products on the website constitutes an invitation to make an offer and not a binding offer within the meaning of Article 7 of the Swiss Code of Obligations.

The ordering process is as follows:

• The Customer selects the products and adds them to the cart.

• The Customer reviews their order and enters their shipping and payment information.

• The Customer confirms their order by clicking the confirmation button, which constitutes an offer to purchase.

• CaviarNoir.ch the order by email. The sales contract is concluded upon receipt of this confirmation.

CaviarNoir.ch the right to refuse or cancel any order for a valid reason (obvious pricing error, suspected fraud, product unavailability).

 

6. Delivery

CaviarNoir.ch currently CaviarNoir.ch to Switzerland and the Principality of Liechtenstein. The shipping terms are as follows:

 

6.1 Canton of Geneva

For orders within the canton of Geneva, CaviarNoir.ch delivery via courier or Swiss Post’s Swiss-Express “La Lune” service. The delivery method is determined by CaviarNoir.ch on the order and availability.

 

6.2 Swiss-Express “La Lune” — Rest of Switzerland and Liechtenstein

For deliveries outside the canton of Geneva, CaviarNoir.ch Swiss Post’s Swiss-Express “La Lune” service, which guarantees refrigerated delivery by 9:00 a.m. the next day for orders placed before 2:00 p.m. on business days.

The products are packed in insulated containers with ice packs to maintain the cold chain.

 

6.3 Shipping Costs

Shipping costs are displayed during the checkout process, before payment is confirmed.

 

6.4 Transfer of Risk

In accordance with Article 185 of the Swiss Code of Obligations, the risk of loss or damage to the goods passes to the Customer upon delivery to the carrier or courier.

 

7. Right of withdrawal and returns

Under Swiss law, there is no statutory right of withdrawal for online purchases (unlike under European law). Since caviar is a perishable food product, orders are binding and final.

 

7.1 Exceptions

CaviarNoir.ch returns or exchanges in the following cases:

• Product damaged upon receipt (packaging visibly damaged).

• Wrong item delivered (item received differs from the one ordered).

• Obvious quality defect (unusual odor, altered texture).

In such cases, the Customer must contact CaviarNoir.ch 24 hours of receipt by email atcaviarnoir.ch, attaching photographs of the product and the packaging. After verification, CaviarNoir.ch a replacement or a full refund.

 

8. Warranty and Liability

CaviarNoir.ch the freshness and quality of its products at the time of delivery. Our caviar must be stored between 0°F and 4°F and consumed by the date indicated on the packaging.

CaviarNoir.ch no liability in the event of:

• Failure by the Customer to comply with storage conditions.

• Delivery delay caused by the carrier.

• Using the product after the best-by date.

• Force majeure (Art. 119 of the Swiss Code of Obligations).

 

9. Data Protection

The processing of personal data is governed by our Privacy Policy, which is available on the website. CaviarNoir.ch personal data in accordance with the revised Federal Data Protection Act (FADP), which has been in effect since September 1, 2023.

 

10. Intellectual Property

All content on thecaviarnoir.ch websitecaviarnoir.ch text, images, logos, trademarks, and design) is the exclusive property of SVD Commerce Sàrl or its partners and is protected by intellectual property law. Any reproduction, even partial, is prohibited without prior written permission.

 

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by Swiss law.

Any dispute arising out of or relating to the formation, interpretation, or performance of these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland, subject to an appeal to the Federal Supreme Court.

For consumers residing in Switzerland, the court of the consumer’s place of residence has exclusive jurisdiction in accordance with Article 32 of the Swiss Civil Procedure Code.
